STUDENT MISCONDUCT/DISCIPLINARY RESPONSE STRUCTURE

MINOR misbehavior on the part of the student which impedes orderly classroom procedure or interferes with the orderly operation of the school.
These misbehaviors can usually be handled by an individual staff member but sometimes require the intervention of other school support personnel. | To Include but not limited to: 1. Class tardiness 2. School tardiness 3. Inappropriate language, conversations or gestures 4. Disruptive behavior in classrooms, halls or cafeteria 5. Lying 6. Littering 7. Dress code violations 8. Possession of audio/video/ electronic devices 9. Unauthorized use of school/ classroom telephones 10. Consumption of food/ beverages outside of approved areas 11. Negligence for returning required forms 12. Verbal confrontation (student to student) 14. Abuse of privileges 15. Failure to possess written hall pass upon request. 16. Public displays of affection 17. Being in authorized areas prior to the start or at the finish of the day 18. Unpreparedness or non -participation in class 19. Failure to follow established departmental course guide-lines 20. Failure to attend a scheduled health room appointment 21.Refusal to positively identify oneself upon request
| There is immediate intervention by the staff member who is supervising the student or who observes the misbehavior.
Repeated misbehavior requires a parent/teacher conference; or a conference with the counselor and/or administrator.
A proper and accurate record of the offense and disciplinary action is maintained by staff member. | First Offense- 1 hour detention
Second Offense- 3 hours detention
Third Offense – 1 day in-school suspension
Fourth Offense – move to Level II |

Behavior whose FREQUENCY or SERIOUSNESS tends to disrupt the learning climate of the school.
These infractions, which usually result from the continuation of LEVEL I misbehaviors, require the intervention of personnel on the administrative level because the execution of LEVEL I disciplinary options has failed to correct the situation. Also included in this level are misbehaviors which do not represent a direct threat to the health and safety of others but whose educational consequences are serious enough to require corrective action on the part of the administrative personnel. |
To include but not limited to:
1. Disrespect to school district employees 2. Harassment – either written or verbal 3. Cutting classes 4. Vulgar language 5. Unsafe laboratory/classroom behaviors 6. Improper use of equipment 7. Failure to attend assigned detention or misbehave during assigned detention (see detention policy) 8. Pushing/shoving 9. Continuation of Level I unmodified behavior 10. Cheating |
The student is referred to the administrator with the appropriate form for disciplinary action.
The administrator meets with the student and/or teacher and applies the appropriate response.
The teacher is informed of the offense and the disciplinary action is maintained by the administrator.
A parental conference is held as needed. |
First Offense – 2 days In School Suspension
Second Offense – 3 days In-School Suspension
Third Offense – 3-5 days In-School Suspension.
Fourth Offense – Move to LEVEL III |
Level III | Examples | Disciplinary Response Procedures | Disciplinary Options/Responses |
Acts directed against persons or property but whose consequences DO NOT SERIOUSLY ENDANGER the health or safety of others in the School.
These acts can be handled by the disciplinary mechanism in the school. Corrective measures which the school should undertake, however, depend on the extent of the school’s resources for remediating the situation in the best interests of all students. |
To include but not limited to: 1. Abuse of school property/ vandalism, etc. 2. Destruction/defacement of academic work/project of another student 3. Threats 4. Fighting 5. Theft 6. Extortion 7. Gambling 8. Possession/sale of stolen property 9. Racial or gender slurs/ intimidation. 10. Incitement of a disturbance 11. Reckless endangerment 12. Forgery/falsification of records 13. Inappropriate conduct/behavior during detention or in- school suspension 14. Defiance of authority/ insubordination 15. Inappropriate gestures to teachers 16. Failure to attend detention or in school suspension 17. Leaving the building without permission 18. Indecent exposure 19. Verbal assaults of district employees 20. Use/possession of tobacco (see smoking/tobacco policy) 21. Acceptable Use of Technology Policy violations (#132) 22. Continuation of Level I or II unmodified behavior

The administrator initiates disciplinary action by investigating the infraction and conferring with staff on the extent of the consequence.
The administrator meets with the student and confers with parent about the student’s misconduct and the resulting disciplinary action.
A proper and accurate record of offenses and disciplinary actions is maintained by the administrator based on referral form submitted by teacher. |
First Offense: 1-3 days out-of- school suspension
Second Offense: 1-5 days out-of-school suspension
Third Offense: 1-10 days out-of-school suspension
Fourth Offense: Move to LEVEL IV Police intervention can occur for any Level III violation based on the severity of the violation
The continuation of unmodified behavior may result in a formal board hearing.
Minimally, a formal school board hearing will be scheduled following:
1. A student’s third incident of Level III or IV violations and, or
2. A total of ten (10) days of accumulated out-of-school suspensions |
Level IV | Examples | Disciplinary Response Procedures | Disciplinary Options/Responses |
Acts which result in VIOLENCE to another person or property which POSE A DIRECT THREAT to the safety of others in the school.
These acts can result in the immediate removal of the student from school, the intervention of law enforcement authorities and action by the Board of School Directors. |
To include but not limited to:
1. Arson 2. Assault and battery 3. Bomb Threat 4. Possession/Use of fireworks 5. Possession/Use of Drugs 6. Threats to school district employees 7. Terroristic threats (written/verbal) 8. Possession/Use of weapons 9. Slander, libel or defamation of character 10. Tampering with security or alarm systems 11. Acceptable Use of Technology Policy violations (#132) 12. Threats/with aggravated circumstances 13. Fighting/with aggravated circumstances 14. Continuation of Level I, II, and /or III unmodified behavior |
Administrator verifies the offense, confers with the staff involved and meets with student. Parents are notified.
The student is immediately removed from the school environment.
The school officials contact law enforcement agency and assist in prosecuting offender, where applicable.
A complete and accurate written report is submitted to the Superintendent for Board action.
Student is given full due process hearing before the Board. |
